Terms of Service for OM Film Lab

These Terms of Service ("Terms") govern your access to and use of the OM Film Lab mobile application ("the App"). By using OM Film Lab, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. License to Use
We grant you a personal, non-exclusive, non-transferable, and revocable license to use OM Film Lab for your personal, non-commercial photography needs, subject to these Terms and Apple's Licensed Application End User License Agreement (EULA).
2. User Accounts
Account Creation: Use of certain features requires an account. You may create an account using Google Sign-In, Apple Sign-In, or Email and Password. You are responsible for maintaining the security of your account credentials.
3. Purchases, Pricing & Lifetime Access
One-Time Lifetime Purchase: OM Film Lab is available through a single one-time purchase of USD $20 (or the equivalent amount in your local currency, as charged by the App Store). This is a lifetime purchase — you pay once and unlock full access permanently. There are no subscriptions, trials, or recurring charges.
What's Included: Your lifetime purchase unlocks: Creative Dial, Export Recipe Card, All Camera Slot Dial, Advanced Olympus Tips (Coming Soon), Unlimited Favorite Recipe, Custom Recipe, Memory Zine, and Export Printable Zine.
Coming Soon Features: Some included features, such as Advanced Olympus Tips, are still in development. They will be added to the App in a future update at no extra cost to lifetime purchasers. We do not guarantee a specific release date.
Future Official Recipes: As a lifetime purchaser, any new official recipe we add to OM Film Lab in the future is included in your purchase at no additional charge. This is a commitment made by the developer of OM Film Lab: you will never be asked to pay again for official recipes we release.
Billing & Refunds: All purchases are billed and processed by Apple through the App Store, and validated using RevenueCat, our purchase and entitlement management provider. We do not collect or store your payment card details. Refund requests must be submitted directly to Apple through the App Store's standard refund process, and are subject to Apple's terms.
Restore Purchases: Your lifetime purchase is linked to your OM Film Lab account as well as the Apple ID used to buy it. If you reinstall the App, switch devices, or sign in on a new device with the same account, use the 'Restore Purchases' option (or simply sign in) to regain access without paying again.
4. Intellectual Property
Your Content: You retain 100% ownership of all photos, videos, and metadata captured or edited using OM Film Lab. We do not claim any rights to your creative work.
Our Content: All app interfaces, original photography "Themes," algorithms, and branding (including the name "OM Film Lab") are the exclusive property of the App developer.
Themes & Parameters: Any "Daily Themes" or camera parameters provided by the App are licensed to you for use within the App and may not be redistributed for commercial purposes without permission.
5. Prohibited Conduct
You agree not to:
Attempt to reverse-engineer, decompile, or extract the source code of the App.
Use the App for any illegal surveillance or activities that violate the privacy of others.
Use automated systems (bots) to scrape data or themes from the App.
6. Termination & Account Deletion
By You: You may stop using the App at any time. In compliance with App Store guidelines, you may request full account and data deletion through the in-app settings or by emailing byatpical@gmail.com.
By Us: We reserve the right to suspend or terminate your access to the App if you violate these Terms or if the App is discontinued.
7. Disclaimers & Limitation of Liability
"As-Is" Basis: OM Film Lab is provided "as-is" and "as available." We do not warrant that the App will be error-free or that your camera parameters will always sync perfectly.
Equipment Safety: We are not liable for any perceived damage to your camera equipment or data loss resulting from the use of the App's manual or synchronized parameters.
No Warranty: To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose.
8. Data Backup & Local Storage
Cloud-Backed Data (Lifetime Purchasers): If you have completed the one-time lifetime purchase, your Camera Info (including any camera banner image), Favorite Recipes, and Custom Recipes (including custom recipe preview photos) are backed up securely to your account. If you sign in on a new device or reinstall the App, this data can be restored.
Free Users: If you have not completed the lifetime purchase, only your basic account profile information (name, email, and profile picture) is stored in the cloud. Your camera info, recipes, and their images are not backed up and remain local to your device only until you purchase.
Local-Only Data: Your Memory Zine, and all photos and videos you capture or import as photography output within OM Film Lab, are stored exclusively on your device's local storage regardless of purchase status. We do not upload, back up, or store this photography output on any external server or cloud service — use the Export Printable Zine or Export Recipe Card feature if you'd like your own copy outside the App.
Missing or Lost Local Data: Because your Memory Zine, captured/imported photography output, and (for users without a completed lifetime purchase) your camera info and recipes reside solely on your device, any missing, deleted, or inaccessible local content is not the responsibility of OM Film Lab. We strongly recommend exporting or backing up anything you want to keep. OM Film Lab shall not be liable for any loss of local data resulting from device failure, accidental deletion, app reinstallation, or any other cause.
9. Governing Law
These Terms shall be governed by the laws of Malaysia. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
